Work Requirements For Foreign Workers in Belgium

Members of the European Union(EU), European Economic Area (EEA), and Swiss Nations do not require a work permit to work in Belgium. However, Non-EU members require a work permit to work in Belgium.

Employers are required to apply for a work permit for their employees before they enter Belgium. They can file for this work permit with the local regional employment officer. Self-employed individuals are to apply for a Professional card at the Belgian Embassy in their country of residence.

There is also a residence permit which is applied for by Non-EU members who wish to stay in Belgium for more than 3 months. However, if the individual has obtained a work permit or professional card, the residence permit will be granted.

Types of Work Permit

Type A

This is the highest type of work permit. It is valid for all employers and paid occupations in Belgium. Employees who apply for this type of work permit have to show proof of working for an uninterrupted 4-year period, on a 10-year stay with a type B permit. It has an indefinite validity.

Type B

This type of work permit is the most common for foreigners. It is issued for a specific job for a specific employer. It is usually applied for by the employer before the employee enters Belgium. In the case where the employee is changing job, the new employer has to apply for another work permit for the employee. In some cases, the employee will have to go back to their home country while the process is in motion.

This type of work permit is valid for a maximum period of up to 12 months irrespective of the contract duration with the employer. However, as long as the employee meets the requirements, the permit can be renewed yearly.

Type C

This type of permit applies to foreign nationals who are staying in Belgium temporarily. Foreigners like students, family members, or persons whose stay in Belgium is not confirmed like asylum seekers, fall under this category. 

This Type C allows holders to take on paid employment in any field and for any job contract for the period that their residence permit allows. It provides its holders with similar rights of employment as Belgian citizens. It has a validity of up to 1 year and can be renewed under certain circumstances.

European Blue Card

This is a combined work and residence permit that allows highly skilled workers from outside the EU to live and work in Belgium for more than 3 months. Its main purpose is to attract highly qualified and educated individuals from outside the European Union to work in the EU.

Professional Card

This card authorizes Non-EU nationals to start a business or be self-employed in Belgium. It acts as a permit and authorizes the foreigner to undertake professional activity in Belgium.
